GENERAL TERMS AND CONDITIONS FOR ONLINE SALES (“The Conditions”)

1. Company information.

Ehthele Limited is a private limited liability company, duly incorporated under the laws of the United Kingdom, with registered office at Unit 3 Cedar Court, 1 Royal Oak Yard, London, England, SE1 3GA and company number 07178249; hereinafter referred to as “Ehthele”.

 

Ehthele has established a remote sales system via https://www.ehthele.com/ (“Website”). The products displayed on the Website are meant to be shipped to the following locations: Europe, including United Kingdom and Switzerland.

2. Scope of Application.

The Conditions apply to all purchases of the products offered by Ehthele on the Website, by physical persons or companies (“Customer/s”).

 

All purchases of the products made via the Website, implies that the Customer(s) has/have fully and wholly agreed to the Conditions.

 

Ehthele reserves the option to change the Conditions at any time without notice. Purchases made under Conditions prior to a modification shall be treated according to the Conditions in force at the time of the transaction.

3. Purchase procedure.

To purchase on the Website the Customer is required to provide personal details (please refer to the Privacy Policy for additional information). At least the Customer must provide the real name, phone number, email address and other requested information as indicated in the registration/ordering process.

 

The Customer needs to provide valid and correct payment details. Ehthele will not assume any responsibility for charges or expenses due to the incorrectness of the previous information, being the Customer responsible to assume these costs.

 

In case that an order has been made, the Customer will receive an email acknowledging the details of the order. This email is NOT an acceptance of the order, just a confirmation that Ehthele staff received it.

 

Unless the Customer cancels the order, the acceptance and completion of the contract between the Customer and Ehthele will be completed when Ehthele emails the Customer to confirm the goods have been dispatched. The sale contract is therefore concluded in London, England and the language of the contract is English.

 

Ehthele reserves the right not to accept the order in the event, for example, that Ehthele is unable to obtain authorisation for payment, that shipping restrictions apply to a particular item, that the item ordered is out of stock or does not satisfy our quality control standards and is withdrawn. In case that the previous situation arises, the Customer shall be informed by email as soon as possible that the products are not available and that all or part of their order has been cancelled.

 

If an entire order is cancelled, Ehthele staff shall contact the Customer to inform about the cancellation and then issue a refund for the total price of the order, which shall occur as quickly as possible and no later than thirty (30) days after the order is cancelled.

 

If an order is partially cancelled:

  • The order will be confirmed and the bank account will be debited for the entire amount of the order.
  • The available products will be shipped to the Customer. Ehthele staff will contact the Customer to inform about non-availability of the products and issue a refund, which will occur as quickly as possible and no later than thirty (30) days after the shipment.

 

Payment can be made by the Customer debit/credit card or other payment methods like Paypal or bank transfer, as advertised on our Website from time to time. Payment will be debited and cleared from the Customer account upon dispatch of the order by Ehthele.

 

The Customer confirms that the credit/debit card that is being used is owned by the Customer or that it has been specifically authorised by the owner of the credit/debit card to use it. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of the payment card refuses to authorise payment to Ehthele, Ehthele will not be liable for any delay or non-delivery.

 

Ehthele reserves the right to suspend or cancel any processing of an order and/or shipment regardless of the type or phase of the processing in the event of a payment default or partial payment of any amount that may be owed by the Customer, if there is a payment issue or in the event of fraud or an attempt to commit fraud pertaining to the use of the site, including in terms of past orders.

 

4. Pricing model.

Shipping costs are included in the product prices shown on the Website as the Items are delivered within Europe, United Kingdom or Switzerland.

 

Ehthele regularly checks the prices on the Website to make sure they are accurate, but sometimes mistakes may happen. If Ehthele staff finds a pricing error in an order, they will inform the Customer as soon as possible.

 

Ehthele has the right to cancel an order with a wrong price. If the order has been paid for, the Customer will get a full refund of the amount paid and, if they have received the order, they will have to return it to Ehthele.

 

The order confirmation email will show the Customer how much they paid for each Item.

 

The VAT rate may differ depending on the country where the Items are delivered.

 

The VAT for the Customer’s order will be calculated when the order is ready to be shipped. Changes in the laws that affect the VAT rate between the time of placing the order and receiving the order confirmation email may change the tax amount for the Customer’s order. If this results in a higher tax for the Customer’s purchase, Ehthele will ask them to confirm their order again.

5. Compliance.

GOLD: Ehthele products are made from 750 gold / 18 k.

DIAMONDS: The diamonds marketed by Ehthele are laboratory grown diamonds.

6. Shipping methods.

Delivery by Carrier

 

The delivery time for the products is estimated to be between one (1) and three (3) working days after the order is shipped. Customers will get an email to notify them when the order is shipped.


Shipping costs are free of charge as long as the Items are delivered within Europe, United Kingdom or Switzerland.

 

Sometimes, there may be delays that we cannot control for reasons such as:

  • Unexpected events
  • Delivery area
  • Traffic problems

 

The Customer must provide a complete and accurate shipping address, including street number, building, stairway, access code, intercom number, etc., to ensure the delivery time is met.

 

Ehthele is responsible for the products until they are delivered to the Customer. After that, the Customer is responsible for them once they receive them at the shipping address they provided.

To avoid any disputes, Ehthele advises the Customer to check the condition of the products when they receive them and, if possible, write down any defects they notice on the delivery slip and sign it (parcel arrived opened, product is damaged, etc.).

7. Return or cancellation of the order.

Customers can cancel their order for any reason within 14 (fourteen) days of receiving the product they want to cancel. If the Customer’s order has more than one product or the products were delivered in different times, the Customer can cancel until 14 days after they, or someone they choose (not the carrier), get the last Item or the last delivery. Only orders in perfect stand will be accepted in return.

8. Warranty.

You have a 24-month warranty from the date you buy our products. This means we will fix or replace any part that is faulty because of how we made it, as long as you send it back to us within that time. We will decide whether to fix or replace the part. After 24 months, you will have to pay for any service or repair.

 

The warranty does not apply if:

  • you damage the product by using it wrong, being careless, or having an accident,
  • the product gets damaged because of things like drops, hits, pressure, scratches, etc., or because you changed, opened, or fixed it yourself or with someone who is not from Ehthele, or because you used parts or accessories that Ehthele did not recommend.
  • we cannot see the serial number that we engraved on the product, or any part of the product is missing, different, changed, replaced, erased or unclear.
  • the product needs normal cleaning or maintenance, or it shows signs of normal use and ageing
9. Materials.

The material displayed on our Website is provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, Ehthele hereby expressly exclude all conditions, warranties and other terms which might otherwise be implied by statute or common law.

 

Any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with our Website or in connection with the use, inability to use, or results of the use of our Website, any websites linked to it and any materials posted on it, including:

  • Loss of income or revenue;
  • Loss of business;
  • Loss of profits or contracts;
  • Loss of anticipated savings;
  • Loss of data;
  • Loss of goodwill.
10. Legal disputes

The English courts will have exclusive jurisdiction over any claim arising from, or related to, these Conditions, although we retain the right to bring proceedings against you for breach of these Terms in your country of residence or any other relevant country.

 

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.
